Prologue to the Additives

The current legislation of Additives in the European Union is today undergoing a complete restructuring.

The main act is Regulation (EC) N° 1333/2008 of the European Parliament and the Council of 16 December 2008 on food additives.
This Regulation replaces previous Directives and decisions concerning food additives permitted for use in foods.
Article 33 of this Regulation repeals several acts as stipulated more precisely in Directive 89/107/EEC, Directive 94/35/EC, Directive 94/36/EC and Directive 95/2/EC.

With reference to the Transitional Provisions of article 34 of regulation 1333/2008, the following acts are still of importance:

  • Framework Council Directive 89/107/EEC of 21 December 1988 on the approximation of the laws of the Member States concerning food additives authorised for use in foodstuffs intended for human consumption, as amended.
  • European Parliament and Council Directive 94/36/EC of 30 June 1994 on colours for use in foodstuffs;
  • European Parliament and Council Directive 94/35/EC of 30 June 1994 on sweeteners for use in foodstuffs, several times amended;
  • European Parliament and Council Directive 95/2/EC of 20 February 1995, on food additives other than colours and sweeteners, several times amended;

All authorised food additives must fulfil purity criteria which are set out in detail in three Commission Directives.
